I have long since relied upon God in terms of knowing what to say.
However, suddenly I was speechless in the physical sense. I was unable to speak. When I opened my mouth, nothing came out. I had to take several glasses of water to begin a word and then it was difficult to speak anything. Perhaps it was the brazen evidence from the bench that this female judge
could care less that a huge church fraud had occurred. For her, the only matter she was concerned with was whether I was entitled to be there in the first place. It was another “rules” argument that I was facing. Was I simply flabbergasted at the incredulity of the argument I was not allowed to refile a
complaint because of the first court decision? I’ve heard being “speechless” comically talked about, but now I experienced it first hand. It wasn’t funny. Perhaps God wanted me to just take whatever this court wanted to dump on me. In the end, that is what I did and exactly what happened.
Jesus said, “Now when they bring you to the synagogues and magistrates and authorities, do not worry about how or what you should answer, or what you should say. For the Holy Spirit will teach you in that very hour what you ought
to say.” Luke 12:11-12
There is a legal doctrine in the “rules” called “res judicata,” which means that the matter has been fully settled. The second judge had
dismissed the case in a way that gave rise to such an argument. The lawyers I talked to must have been ignorant or I was simply dumped on in violation of my rights, again. With 20-days to file an appeal, I just took the dump of this unrighteous female judge. This issue of fraud was now ignored by
another court rule, which says that summary judgment, once granted, cannot be re-litigated. The first Court Order did not state “with prejudice” so every attorney I counseled with believed that I could refile. Go figure.
The third Judge dismissed the case “with prejudice” and ruled that I was harassing the church and Matthews’ privies [other defendants] and awarded the defendants a total of $16,694.87 in costs and attorney fees to be paid of course by me. Imagine getting fined for standing up and reporting a
$6 million dollar church theft. Now imagine that two of three judges turned their backs on the evidence of the fraud and used “rules” to dismiss the case.
